Studies on end-of-life care reveal different practices regarding withholding and/or withdrawing life-sustaining treatments between countries and regions. Available data about physicians’ practices regarding end-of-life care in ICUs in Egypt is scarce. This study aimed to investigate physicians’ attitudes toward end-of-life care and the reported practice in adult ICUs in Ain Shams University Hospitals, Cairo, Egypt. 100 physicians currently working in several ICU settings in Ain Shams University Hospitals were included. A self-administered questionnaire was used for collection of data. Most of (...) the participants agreed to implementation of “do not resuscitate” orders and applying pre-written DNR orders, while only 13% almost always/often order DNR for terminally-ill patients. 52% of the participants agreed to usefulness of limiting life-sustaining therapy in some cases, but they expressed fear of legal consequences. 47% found withholding life-sustaining treatment is more ethical than its withdrawal. 16% almost always/often withheld further active treatment but continued current ones while only 6% almost always/often withdrew active therapy for terminally-ill patients. The absence of legislation and guidelines for end-of-life care in ICUs at Ain Shams University Hospitals was the main influential factor for the dissociation between participants’ attitudes and their practices. Therefore, development of a consensus for end-of-life care in ICUs in Egypt is mandatory. Also, training of physicians in ICUs on effective communication with patients’ families and surrogates is important for planning of limitation of life-sustaining treatments. (shrink)

Objective To determine the attitudes of Egyptian patients regarding their participation in research and with the collection, storage and future use of blood samples for research purposes. Design Cross-sectional survey. Study population Adult Egyptian patients (n=600) at rural and urban hospitals and clinics. Results Less than half of the study population (44.3%) felt that informed consent forms should provide research participants the option to have their blood samples stored for future research. Of these participants, 39.9% thought that consent forms should (...) include the option that future research be restricted to the illness being studied. A slight majority (66.2%) would donate their samples for future genetic research. Respondents were more favourable towards having their blood samples exported to other Arab countries (62.0%) compared with countries in Europe (41.8%, p<0.001) and to the USA (37.2%, p<0.001). Conclusions This study shows that many individuals do not favour the donation of a blood sample for future research. Of those who do approve of such future research, many favour a consent model that includes an option restricting the future research to the illness being studied. Also, many Egyptians were hesitant to have their blood samples donated for genetic research or exported out of the Arab region to the USA and European countries. Further qualitative research should be performed to determine the underlying reasons for many of our results. (shrink)

Drawing upon rational choice and investor attention theories, we examine how accusations of corporate bribery and subsequent investigations shape market reactions. Using event study methodology to measure loss in firm value for public firms facing bribery investigations from 1978 to 2010, we found that total market penalties amounted to $60.61 billion. We ran moderated multiple regression analysis to examine further the degree to which the unique characteristics of bribery explain variations in market penalties. Companies committing bribery in less corrupt host (...) countries and with the involvement of compromised executives experienced greater market penalties than did other companies. After partitioning share value losses into components for regulatory penalties, class action settlements, and loss to reputation, we found that reputational penalties account for 81.8¢ of every dollar of share value loss. Omission of reputational penalties in rational choice calculus underestimates bribery costs by 4.5 times. The results suggest that firms should not underestimate the importance of market-imposed reputational penalties by merely considering regulator-imposed fines and sanctions. (shrink)

The term non-governmental organisations (NGOs) has been well-known for the development of human rights, charity works and organisational developments. On the other hand, some NGOs also have their specialised roles to help the community such as in conflict resolution, cultural preservation, policy analysis and information provision. Apart from that, there are many categories of NGOs: Islamic-oriented non-governmental organisation (IONGOs), faith-based organisation (FBO), humanitarian NGOs (HNGOs) and government organised NGOs (GONGOs). However, in this research, the researchers focus on how IONGOs compare (...) with NGOs in assisting the lesbian, gay, bisexual, and transgender (LGBT) community based on four hijrah NGOs: Persatuan Islah Movement, Persatuan Insaf Pahang, Hijrah Republique Network and Usrah Iqrak. These four NGOs were chosen because of their roles in assisting the LGBT community. In this research, the researchers adapt the qualitative research by using a case study method; phenomenological approaches and a document analysis have also been applied as well. The result shows that these four IONGOs are different from the NGOs based on the seven typologies applied: intersection, distinct, substantive, subset, co-existing, atomistic grouping and constitutive. The implications of this article highlight the fact that IONGOs are different from the LGBT NGOs in Malaysia as they focus more on spirituality and an Islamic pathway. Hence, future research should include focus group interviews with all the members in NGOs that assist the LGBT hijrah in the community. The most prominent form of human communication and interaction is speech. It plays an indispensable role for expressing emotions, motivating, guiding, and cheering. An ill-intentioned speech can mislead people, societies, and even a nation. A misguided speech can trigger social controversy and can result in violent activities. Every day, there are a lot of speeches being delivered around the world, which are quite impractical to inspect manually. In order to prevent any vicious action resulting from any misguided speech, the development (...) of an automatic system that can efficiently detect suspicious speech has become imperative. In this study, we have presented a framework for acquisition of speech along with the location of the speaker, converting the speeches into texts and, finally, we have proposed a system based on long short-term memory which is a variant of recurrent neural network to classify speeches into suspicious and nonsuspicious. We have considered speeches of Bangla language and developed our own dataset that contains about 5000 suspicious and nonsuspicious samples for training and validating our model. A comparative analysis of accuracy among other machine learning algorithms such as logistic regression, SVM, KNN, Naive Bayes, and decision tree is performed in order to evaluate the effectiveness of the system. The experimental results show that our proposed deep learning-based model provides the highest accuracy compared to other algorithms. (shrink)

Martin Buber has always made it clear that his dialogic principle is not to be treated as an abstract conception but an ontological reality. But admittedly, in I And Thou he could only point to such reality and could not properly present it in discursive prose. However there are instances in the text where he strives to do the latter. One particular instance is where he elaborates the emergence of consciousness of “I”. Through this elaboration, what Buber has tried to (...) point at is the bringing forth of the primary word ‘I-It’ forming part of his dialogic principle, as it ‘emerges round about’ the perceptual consciousness realised in body as some sort of a ‘primitive function of knowledge’. However, this still amounts only to an abstract conception, and not to a description of ontological reality as Buber would have aspired for. Hence the thought: what if there exists an endeavour carried out independently of Buber’s work, nevertheless in the same spirit as Buber but without his notorious mixing up of philosophy and religion? There indeed has been such an Existential-phenomenological take on embodiment and perception by the French phenomenologist Maurice Merleau-Ponty, as is laid out in his magnum opus Phenomenology of Perception. In the present paper we will explicate this interesting coincidence, thereby honouring Buber’s aspiration for ontological status to his dialogic principle, at the same time demonstrating how existentially resonating and ontologically converging the thought of these two great thinkers’ have been, though they had totally different intellectual pursuits and concerns. The process of making ethical judgments is much more complex than studying only personal moral philosophy variables (idealism and relativism). The renewed interest in epistemic values (virtue and vice epistemology) in contemporary philosophy has shown significant relevance to understanding ethical behavior and such values may be better predictors than studying only idealism and relativism. The purpose of this exploratory study is to examine employees’ personal moral philosophies, optimism, epistemic values, and various organizational unethical practices as compared to their managers. We (...) used Rawwas’ items of epistemology in this study. The sample consisted of 262 managers and employees. The results revealed that managers were more sensitive to organizational unethical practices, scored less on epistemic vices, less on absolutism, and more on exceptionalism than employees were. However, there was no difference between managers and employees related to moderate and minor unethical organizational practices, situationism, subjectivism, optimism, and epistemic virtues. Parkinson's Disease (PD) is a long-term degenerative disorder of the central nervous system that mainly affects the motor system. The symptoms generally come on slowly over time. Early in the disease, the most obvious are shaking, rigidity, slowness of movement, and difficulty with walking. Doctors do not know what causes it and finds difficulty in early diagnosing the presence of Parkinson’s disease. An artificial neural network system with back propagation algorithm is presented in this paper for helping doctors in identifying (...) PD. Previous research with regards to predict the presence of the PD has shown accuracy rates up to 93% [1]; however, accuracy of prediction for small classes is reduced. The proposed design of the neural network system causes a significant increase of robustness. It is also has shown that networks recognition rates reached 100%. (shrink)

Purpose This study aims to analyze how English-language versions of e-newspapers in the first two countries affected, China and Japan, which are non-English-speaking countries and have different socio-economic and political settings, have highlighted Coronavirus disease 2019 pandemic news and informed the global community. Design/methodology/approach A text-mining approach was used to explore experts’ thoughts as published by the two leading English-language newspapers in China and Japan from January to March 2020. This study analyzes the Opinion section, which mainly comprises editorial and (...) the op-ed section. The current study groups all editorial discussions and highlights into ten major aspects, which cover health, economy, politics, culture and others. Findings Within the first three months, the media in both China and Japan shifted their focus from health and preparedness to the economy, politics and social welfare. Governance and social welfare were key concerns in China’s news media, while, in contrast, global politics received the highest level of attention from experts in Japan’s news media. Environment and technologies aspects did not receive much attention by the expert’s columns. Originality/value At the initial stage of a world crisis, how leading nations and initially affected nations deal with the problem, how media play their role and guide mass population with experts’ thoughts are highlighted here. The understanding developed in this study can provide guidance to news media in other countries in playing effective roles in the management of this health crisis and catastrophes. (shrink)

The Heisenberg-Gabor uncertainty principle defines the limits of information resolution in both time and frequency domains. The limit of resolution discloses unique properties of a time series by frequency decomposition. However, classical methods such as Fourier analysis are limited by spectral leakage, particularly in longitudinal data with shifting periodicity or unequal intervals. Wavelet transformation provides a workable compromise by decomposing the signal in both time and frequency through translation and scaling of a basis function followed by correlation or convolution with (...) the original signal. This study aimed to compare the accuracy of predictive models in mental arithmetic in time and frequency domains. Analysis of the author's response time at mental arithmetic using a soroban was modeled for two periods, an initial period, and a return period both separated by an interval of 370 days. The median response times in seconds was longer for all tasks during the TI compared to the TR period, for addition [CTAdd 62 vs 50 s] and summation [CTSum 68 vs 57 s]. Response times were longer for errors regardless of the study period or task. There was an increasing phase difference for the addition and summation tasks during the TI period toward the end of the series 49.65o compared to the TR period where the phase difference between the two tasks was only 2.05o, indicating that both tasks are likely demonstrating similar learning rates during the latter study period. A comparison between time and time/frequency domain forecasts for an additional 100 tasks demonstrated higher accuracy of the maximum overlap discrete wavelet transform model, where the mean absolute percentage error ranged between 5.48 and 8.19% and that for the time domain models [autoregressive integrated moving average, generalized autoregressive conditional heteroscedasticity ] was 6.16–10.80%. ObjectiveTo prospectively study the cingulate cortex for the localization and role of the grasping action in humans during electrical stimulation of depth electrodes.MethodsAll the patients with intractable focal epilepsy and a depth electrode stereotactically placed in the cingulate cortex, as part of their pre-surgical epilepsy evaluation from 2015 to 2017, were included. Cortical stimulation was performed and examined for grasping actions. Post-implantation volumetric T1 MRIs were co-registered to determine the exact electrode position.ResultsFive patients exhibited contralateral grasping actions during electrical stimulation. (...) All patients had electrodes implanted in the ventral bank of the right cingulate sulcus adjacent to the vertical anterior commissure line. Stimulation of other electrodes in adjacent regions did not elicit grasping.ConclusionGrasping action elicited from a localized region in the mid-cingulate cortex directly supports the concept of the cingulate cortex being crucially involved in the grasping network. This opens an opportunity to explore this region with deep brain stimulation as a motor neuromodulation target for treatment in specific movement disorders or neurorehabilitation. (shrink)

Background: Post-mortem needle biopsies have been used in resource-poor settings to determine cause of death and there is interest in using them in Bangladesh. However, we did not know how families and communities would perceive this procedure or how they would decide whether or not to consent to a post-mortem needle biopsy. The goal of this study was to better understand family and community concerns and decision-making about post-mortem needle biopsies in this low-income, predominantly Muslim country in order to design (...) an informed consent process. Methods: We conducted 16 group discussions with family members of persons who died during an outbreak of Nipah virus illness during 2004-2008 and 11 key informant interviews with their community and religious leaders. Qualitative researchers first described the post-mortem needle biopsy procedure and asked participants whether they would have agreed to this procedure during the outbreak. Researchers probed participants about the circumstances under which the procedure would be acceptable, if any, their concerns about the procedure, and how they would decide whether or not to consent to the procedure. Results: Overall, most participants agreed that post-mortem needle biopsies would be acceptable in some situations, particularly if they benefitted society. This procedure was deemed more acceptable than full autopsy because it would not require major delays in burial or remove organs, and did not require cutting or stitching of the body. It could be performed before the ritual bathing of the body in either the community or hospital setting. However, before consent would be granted for such a procedure, the research team must gain the trust of the family and community which could be difficult. Although consent may only be provided by the guardians of the body, decisions about consent for the procedure would involve extended family and community and religious leaders. Conclusions: The possible acceptability of this procedure during outbreaks represents an important opportunity to better characterize cause of death in Bangladesh which could lead to improved public health interventions to prevent these deaths. Obstacles for research teams will include engaging all major stakeholders in decision-making and quickly building a trusting relationship with the family and community, which will be difficult given the short window of time prior to the ritual bathing of the body. The literature analysing Muslim perspective towards other religions is now quite extensive. However, when it comes to Muslim’s perspective towards Buddhism, the scholarship lags far behind. This article aimed to identify the Muslim views on Buddhism from a theological and philosophical framework. The Muslim views have a different category, on categorising Buddhism, the status of Buddha as a Prophet, and Buddhist as the People of the Book. Each view provides a different framework of Muslim perspective towards Buddhism. From the theological (...) view, one of the outlook is tolerance. Due to the rejection of Buddhist doctrine by most Muslim theologians, Muslims apply tolerance, which is subject to religious freedom stand on, ‘firm in principle, tolerant in attitude’. Tolerance encourages Muslims to adhere to the principles of truth, but does not erode the respect for other religion. While from a philosophical view, it considered Buddhism as a religion from God, as well as other religions. Thus, some Muslim inclusivists and pluralists recognise Buddhism. This research is qualitative. The method used in this research is descriptive-analytic, emphasising content analysis of the data from various books and articles covering Muslim view on Buddhism and the patterns of relations between Islam and Buddhism. Studies suggest the understanding of each framework to encourage Muslims to improve comprehensive interreligious dialogue with Buddhists.Contribution: Religious tolerance, inclusivism, and pluralism is a panacea to inordinate and incessant religious conflict, if given its proper place in Malaysia, it will breed harmony and peace in the society. While there has been much discussion of how the scientific establishment’s culture can engender research misconduct and scientific irreproducibility, this has been discussed much less frequently with respect to the medical profession. Here the authors posit that a lack of self-criticism, an encouragement of novel scientific research generated by the recruitment policies of the UK Royal Training Colleges along with insufficient training in the sciences are core reasons as to why research misconduct and dishonesty prevail within the medical community. Furthermore, (...) the UK General Medical Council’s own data demonstrates a historic inattentiveness to the ease with which doctors can engage in research misconduct. Muslim communities in the village facing the COVID-19 Pandemic attempts to find refuge from the plague and hope for survival. However, this led to more caution, which may lead to xenophobia. Via ethnography, this study unmasks the xenophobic attitude. This research discusses the root causes of panic in the community so that remedies can be implemented. The research attempts to explain, from a socio-anthropological viewpoint, how people and religious groups in the village perceive the pandemic of COVID-19 based on their (...) belief in their faith and in the science. The research takes place in Cigagak village, an area of approximately 7000 m2 on the outskirts of Bandung of West Java of Indonesia. This study examines the selected respondents from about 190 inhabitants who had close ties to managing places of worship and public places. This study utilises a collaborative self-ethnographic method and qualitative analysis. The influence of COVID-19 has moved to new exclusive and disintegrating practices from the inclusion-cohesive religious tradition. Therefore, this study tries to find out ways on how to reduce exclusive perception and religious practices to a minimum level and how to disappear xenophobia. Amid the COVID-19 Pandemic, inclusive awareness and actions were re-established, and even social cohesiveness was fostered. This study concludes that in its deep conviction nature, theology can change exclusive behaviour to be inclusive if it is based on the religious principles that are raised in response to human events. In this case, the Muslim community in a village can change the fear of COVID-19 pandemic to be a reducer of the panic based on the support of the religious doctrines.Contribution: This article used a collaborative self-ethnography with a religious socio-anthropological viewpoint. This study could help to solve social problems through theological convergence in Islamic milieu, especially that of the government’s formal Islamic organisation and organic Islamic leaders of the society. A growing body of work suggests that the presence of women and of independent directors on boards of directors is associated with higher corporate environmental performance. However, the mechanisms linking board composition to corporate environmental performance are not well understood. This study proposes and empirically tests the mediating role of sustainability-themed alliances in the relationship between board composition and corporate environmental performance. Using the population of public oil and gas firms in the United States as the sample, the study relies (...) on renewable energy alliances to measure sustainability-themed alliances and longitudinally analyzes lagged data for independent and control variables. The study found that the higher the representation of women on a firm’s board, the more likely the firm is to form sustainability-themed alliances, and the higher the representation of independent directors on a firm’s board, the more likely the firm is to form sustainability-themed alliances. Such alliances, in turn, positively contribute to corporate environmental performance. This paper discusses the study’s contributions to the board composition-social performance literature. (shrink)

Lincoln and Guba provided some principles and four evaluative criteria called “trustworthiness” to guide social science research naturalistically. However, drawing on Science and Technology Studies (STS) literature, a field engaged with methods and practices of science for several decades, one can argue that this approach is not still fully naturalistic. In this paper, we review Lincoln and Guba’s four criteria of trustworthiness from an STS perspective. We argue that the STS literature can challenge these criteria, but at the same time (...) they have the potential to be reconstructed with the help of the materials STS provides. (shrink)

One way to compare different theoretical approaches to the study of technologies is to see what the difference is between their narratives of the construction of a particular technology. In this paper, we re-narrate the bicycle construction from the perspective of actor-network theory (ANT), comparing to SCOT’s first account of the construction. Although SCOT has moved closer to actor-network theory later by paying more attention to co-construction and materliaty, Pinch and Biker have not modified their account of the bicycle development (...) according to these theoretical changes, despite the fact that one decade later Bijker allocated one chapter, ‘king of the road’, to Safety bicycle development again. An ANT’s narrative of bicycle development can provide a basis for a concrete comparison between ANT and the classic version of SCOT. Or it could be argued that this narrative could complement the story of Pinch and Biker of bicycle development. While we present a new narrative of bicycle development in comparison with SCOT’s one, we offer a methodological framework in the ANT literature that can be considered as a methodological procedure to the study of artefacts in general; this framework has three elements: 1. Phenomenal Bracketing, 2. Collective construction, and 3. Co-construction. (shrink)

Cet article s’attache à définir la nation, en Afrique, par la notion de « révolution », c’est-à-dire d’une transformation totale de conditions anciennes – aussi bien précoloniales que coloniales – en vue de fonder des structures nationales progressistes et démocratiques. Usant de l’exemple des pays du Sahel, en particulier le Burkina Faso, le Mali et le Niger, l’article analyse cette révolution nationale comme un phénomène de cycle long, qui se déploie dans une contradiction entre un leadership politique de moins en (...) moins en adéquation avec elle, et des peuples de plus en plus conscients et exigeants quant à leurs droits civiques. Cette contradiction est par ailleurs déterminée différemment par les problèmes politiques propres au cadre urbain et au cadre rural. Elle aboutit à des luttes et contestations opposant peuples et élites qui indiquent que, si la révolution nationale est loin d’être accomplie, elle n’a pas non plus simplement avorté. (shrink)

The Theme. Strong forcing axioms like Martin’s Maximum give a reasonably satisfactory structural analysis of $H(\omega _2)$. A broad program in modern Set Theory is searching for strong forcing axioms beyond $\omega _1$. In other words, one would like to figure out the structural properties of taller initial segments of the universe. However, the classical techniques of forcing iterations seem unable to bypass the obstacles, as the resulting forcings axioms beyond $\omega _1$ have not thus far been strong enough! However, (...) with his celebrated work on generalised side conditions, I. Neeman introduced us to a novel paradigm to iterate forcings. In particular, he could, among other things, reprove the consistency of the Proper Forcing Axiom using an iterated forcing with finite supports. In 2015, using his technology of virtual models, Veličković built up an iteration of semi-proper forcings with finite supports, hence reproving the consistency of Martin’s Maximum, an achievement leading to the notion of a virtual model.In this thesis, we are interested in constructing forcing notions with finitely many virtual models as side conditions to preserve three uncountable cardinals. The thesis constitutes six chapters and three appendices that amount to 118 pages, where Section 1 is devoted to preliminaries, and Section 2 is a warm-up about the scaffolding poset of a proper forcing. In Section 3, we present the general theory of virtual models in the context of forcing with sets of models of two types, where we, e.g., define the “meet” between two virtual models and prove its properties.The main results are joint with Boban Veličković, and partly appeared in Guessing models and the approachability ideal, J. Math. Log. 21 (2021).Pure Side Conditions. In Section 4, we use two types of virtual models (countable and large non-transitive ones induced by a supercompact cardinal, which we call Magidor models) to construct our forcing with pure side conditions. The forcing covertly uses a third type of models that are transitive. We also add decorations to the conditions to add many clubs in the generic $\omega _2$. In contrast to Neeman’s method, we do not have a single chain, but $\alpha $ -chains, for an ordinal $\alpha $ with $V_\alpha \prec V_\lambda $. Thus, starting from suitable large cardinals $\kappa <\lambda $, we construct a forcing notion whose conditions are finite sets of virtual models described earlier. The forcing is strongly proper, preserves $\kappa $, and has the $\lambda $ -Knaster property. The relevant quotients of the forcing are strongly proper, which helps us prove strong guessing model principles. The construction is generalisable to a ${<}\mu $ -closed forcing, for any given cardinal $\mu $ with $\mu ^{<\mu }=\mu <\kappa $.The Iteration Theorem. In Section 5, we use the forcing with pure side conditions to iterate a subclass of proper and $\aleph _2$ -c.c. forcings and obtain a forcing axiom at the level of $\aleph _2$. The iterable class is closely related to Asperó–Mota’s forcing axiom for finitely proper forcings.Guessing Model Principles. Section 6 encompasses the main parts of the thesis. We prove the consistency of the guessing principle $\mathrm {GMP}^+(\omega _3,\omega _1)$ that states for any cardinal ${\theta \geq \omega _3}$, the set of $\aleph _2$ -sized elementary submodels M of $H(\theta )$, which are the union of an $\omega _1$ -continuous $\in $ -chain of $\omega _1$ -guessing, I.C. models is stationary in $\mathcal P_{\omega _3}(H(\theta ))$. The consistency and consequences of this principle are demonstrated in the following diagram. We also prove that one can obtain the above guessing models in a way that the $\omega _1$ -sized $\omega _1$ -guessing models remain $\omega _1$ -guessing model in any outer transitive model with the same $\omega _1$, and we denote this principle by $\rm{SGMP}^+(\omega_3,\omega_1)$.In the following diagram, $\mathrm{TP}$ stands for the tree property; $w\mathrm{KH}$ stands for the weak Kurepa Hypothesis; $\mathrm{MP}$ stands for Mitchell property, i.e., the approachability ideal is trivial modulo the nonstationary ideal; $\mathrm{AP}$ stands for the approachability property; $\mathrm {AMTP}(\kappa ^+)$ states that if $2^\kappa <\aleph _{\kappa ^+}$, then every forcing which adds a new subset of $\kappa ^+$ whose initial segments are in the ground model, collapses some cardinal $\leq 2^{\kappa }$. Bioethics is a multidisciplinary and interdisciplinary field that goes beyond the realm of natural sciences, and has involved fields in the domain of the social sciences. One of the important areas in bioethical discourse is religion. In a country like Malaysia, where Muslims make up the majority of the population, Islam plays a crucial role in providing the essential guidelines on the permissibility and acceptability of biotechnological applications (...) in various fields such as medicine, agriculture, and food processing. This article looks at the framework of a complementary model of bioethics derived from the perspective of Islam. The framework is based on ‘maqasid al-shariah’ (purposes or objectives of Islamic law) which aims to protect and preserve mankind’s faith, life, intellect, progeny, and property. It is proposed that ‘maqasid al-shariah’ be used as a pragmatic checklist that can be utilized in tackling bioethical issues and dilemmas. (shrink)

The main aim of this study is to undertake a critical examination of the ethical and developmental performance of an Islamic bank as communicated in its annual reports over a period of 28 years. Islami Bank Bangladesh Limited’s ethical performance and disclosures are further analyzed through interviews conducted with the bank’s senior management. The key findings include an overall increase in ethical disclosures during the study period. However, the focus on various stakeholders’ needs has varied over time reflecting the evolving (...) nature of the Islamic finance industry over the last three decades. Based on a secular economy, IBBL focused in the first two decades on the “Particular” Shariah compliance disclosure as a way of establishing its reputation and differentiating itself from conventional banks in a dual banking system. Post 2005, the ethical performance and disclosure shifted to more “Universal” disclosures such as sustainability, charity, employees, and community related disclosures signaling responsible conduct and the bank’s adoption of a “wider stakeholder approach.” However the bank is still failing to provide full disclosure on certain significant categories such as sources and uses of disposable income, thereby contradicting the principles of full and comprehensive disclosure and accountability. In addition, the structure of IBBL’s investment portfolio reveals an overreliance on debt-based financial instruments and a shortcoming in fulfilling the developmental and social objectives of Islamic finance. This is evidenced by the “qualified” Shariah Supervisory Board reports that the bank consistently received. This research provides further evidence that Islamic banking and Finance in its current practices reflect the “global” and the “local” influences in an era dominated by global conventional finance. In her book Fiction and Metaphysics (1999) Amie Thomasson, influenced by the work of Roman Ingarden, develops a phenomenological approach to fictional entities in order to explain how non-fictional entities can be referred to intrafictionally and transfictionally, for example in the context of literary interpretation. As our starting point we take Thomasson’s realist theory of literary fictional objects, according to which such objects actually exist, albeit as abstract and artifactual entities. Thomasson’s approach relies heavily on the notion of ontological dependence, (...) but its precise semantics has not yet been developed. Moreover, the modal approach to the notion of ontological dependence underlying the Artifactual Theory has recently been contested by several scholars. The main aims of this paper are (i) to develop a semantic approach to the notion of ontological dependence in the context of the Artifactual Theory of fiction, and in so doing bridge a number of philosophical and logical gaps; (ii) to generalize Thomasson’s categorial theory of ontological dependence by reconstructing ontological categories of entities purely in terms of different structures of ontological dependence, rather than in terms of the basic kinds of entities the categorical entities depend on. Today, the risk management of budget challenges throughout the budget process is greater than ever. The process of change has been driven by new information and communication technologies, resulting in e-government. The purpose of this scientific paper is to see whether budgetary challenges have an effect on the performance of e-government in complex financial systems based on factors F1, F2, F3, F4, and F5: lack of information, lack of cooperation, lack of resources and reduction of focus, lack of budget experts (...) and financial stability, and shortcomings and inconsistencies during the budget process. Therefore, this study aims to advance the understanding of how to manage risks from budgetary challenges by focusing on a novel approach to improve e-government performance in complex financial systems. Empirical research was based on three key issues: an approach to e-government, analyzing which variables need more attention to risk, and learning how to meet budgetary challenges to improve performance during governance. For this study, the data were conducted by Kosovo’s public institutions, more specifically at the central level and at the local level. A total of 38 questionnaires were analyzed and divided into three sessions, which were analyzed through three analyses, such as factor analysis, data reliability analysis, and multiple regression analysis, using SPSS version 23.0 for Windows. The research was conducted over the years 2017, 2018, 2019, and 2020, while the analysis involved several processes, where some of the factors were removed in order to make the model acceptable. In this case, 21 variables were tested and divided into 5 factors. The results showed that special attention should be paid to these factors to reduce budgetary challenges and increase the performance of e-government in complex financial systems, such as lack of resources, increasing the focus on risk management even after the transfer of funds from the ministry to the municipality, the selection of programs based on priorities and not on the basis of wishes and policies, having political stability, rule of law, and more control, and having regulations and guidelines from the practices of developed countries as well as taking into account the opinions of budget experts. The implications of this paper have to do with only a considerable number of variables, which were taken in the study as well as only in the municipalities of Kosovo. Previous studies have shown that sibling conflicts are detrimental to physical and psychological development, as well as long-term human development. Although many studies have discovered relations between parenting style and sibling conflicts, these findings were contentious and did not provide a universal solution. Therefore, the meta-analysis was used as the method to determine the nature and magnitude of the relationships. There were a total of 14,356 participants in the 16 included studies, from which 55 effect sizes were extracted. According to (...) the overall meta-analysis results, authoritative parenting did have the potential to reduce sibling conflicts. Neglectful, inconsistent, indulgent, and authoritarian parenting styles were related to sibling conflicts in a positive way. Moreover, the study investigated the effectiveness of several moderator variables, such as children’s gender, age, region, outcome measure, and publication year. The research indicates that authoritative parenting is a protective factor of sibling conflicts. Moderator analyses found that gender, age, region, outcome measure, and publication year played moderating roles in the relationships. In order to improve early childhood physical education, in this study, the talent cultivation mechanism for undergraduates was explored under the “full-practice” concept, oriented by preschooler mental health. First, from the perspective of preschooler psychology, the mechanisms of ability training and talent cultivation for undergraduates majoring in early childhood education were explored under the “full-practice” concept. Considering that the physical, psychological, and intellectual development of preschoolers shall follow the rules of physical education, and current early childhood education mainly focuses on (...) intelligence education in China, early childhood physical education was analyzed further in this study. By investigating the undergraduate majors of early childhood education in Henan University, this study first summarized the current problems in early childhood education systems in universities. Secondly, combined with the form of physical education in kindergartens, strategies for talent cultivation and curriculum setting of early childhood physical education majors in colleges and universities were proposed. Finally, from the perspective of innovation and diversification of training forms, the cultivation of early childhood educators’ physical education ability was analyzed at multiple levels and multiple objectives, and the integrated training system of early childhood education talents was constructed. The results show that, among all the courses for early childhood education major, compulsory courses account for 81.2% and optional courses account for 18.8%. In addition, a survey on undergraduates’ attitudes toward the curriculum of their major demonstrates that 81.2% of the undergraduates thought that the range and content of practical courses should be increased, indicating that undergraduates majoring in early childhood education are dissatisfied with the current curriculum system, and they have an increased demand for practical courses. Correspondingly, it is vital to build and improve on the early childhood physical education. In terms of its talent cultivation, the “full-practice” concept helps combine theory with practice to improve the effectiveness of education and teaching, pushing forward the reform of the education system. Meanwhile, data- and intelligence-oriented teaching will become the new direction of modern sports development, as well as an important link for tracking and monitoring children’s sports teaching in China. Through the continuous introduction of wearable artificial intelligence products, real-time monitoring of children’s physical conditions can be realized, which helps improve the effectiveness of early childhood physical education. In the twenty-first century, the focus of science and technology (S&T) on the human interests and the accessible interests of society, and so the rise of some questions concerning the impact of S&T on social norms, has led to embedding ethical debates in S&T policy-making. The ethics of S&T policy-making, as a representation of the relationship between ethics and S&T policy-making, is a relatively new area of applied and professional ethics that addresses the dilemmas and ethical challenges of the S&T (...) policy-making process. Understanding and recognizing the ethical components of S&T policy-making, one can develop a normative framework to assist policymakers in designing and analyzing ethical policies in the S&T field. The design and development of such a framework is the main purpose of the present study. In this study, the components of the proposed framework for ethical policy-making in S&T, their ethical and policy approaches, as well as their fundamental ethical and policy principles have been identified through studying sources and texts related to meta-ethics, normative ethics, and S&T ethics. Then, these components have been categorized in the form of steps for ethical policy-making using the thematic analysis method. Based on the results of this study, the ethical policy-making steps in S&T include problem identification, information gathering and feeding of the policy process, policy advice and policy formulation, policy implementation, and policy evaluation, which follow 9 ethical principles and 13 policy principles. Numerous studies have examined the manner in which minority groups, including refugees, are depicted in the media discourse of the host countries or the dominant majority groups. The results of such studies indicate that media systematically discriminate these minority groups and deem them as a security, economic and hygiene threat to the majority groups. Through the use of Lakoff and Jonson’s conceptual metaphor theory, this study compares and contrasts the representation of Syrian refugees in the online media discourse of not (...) only host countries but also non-host countries, which, in this study, refers to nations that do not host Syrian refugees. The results show that statistical differences between the metaphors used by host and non-host countries only occur when using the metaphors that describe the entry of refugees and the burden they are inflicting on the host countries. This is clearly indicated by the p-values of the log-likelihood test. (shrink)

Muhammad Arsyad Al-Banjari who lived from 1710 to 1812 in Borneo, Indonesia, applied a model of integrating uses of the Banjarese tradition into Islamic Jurisprudence based on a dialectical constitution of qiyās, the legal argumentation theory for parallel reasoning and analogy, he learned from the Shāfi‘ī-school of jurisprudence (uṣūl al-fiqh). Our paper focuses in the model of integration proposed and practiced by Al-Banjari, a rational debate grounded on a dynamic view on legal systems. We will illustrate the method with the (...) help of two different kinds of qiyās deployed by Al-Banjari in order to argue for the rejection of some traditional Banjarese offering-rituals for avoiding disease or calamities (manyanggar and mambuang pasilih), and for the acceptance of the use of consuming the traditional drink called lahang made of the juice of sugar-palm. As our dialogical reconstruction shows, the development of the debates, particularly the first one, is quite sophisticated, with a Banjarese opponent that does not surrender easily to the rejection of his use of those rituals. The main aim of our paper is to implement Leibniz's analysis of the conditional right in the framework of a dialogical approach to Public Announcement Logic. According to our view, on one hand: PAL furnishes a dynamic epistemic operator which models communication exchange between different agents that seems to be very close to Leibniz understanding of the dynamics between the truth of a proposition and the knowledge of the truth of that proposition (Leibniz calls the latter certification of its truth); (...) on the other hand, the dialogical approach provides a semantics for the dynamic epistemic operator in the context of conditional right by means of which: (i) the exchange between agents leading to a public announcement amounts to the (contractual) interaction of commitments of both the benefactor and the beneficiary of a conditional right (ii) the notion of certification is understood as an action, namely as a move where the beneficiary asks the benefactor to stand to his commitments, (iii) some restrictions specific to the logical nature of the head and the tail of the conditional right can be implemented by combining PAL with some features of linear logic within the same theory of meaning. La réflexion philosophique sur la non-existence est une thématique qui a été abordée au commencement même de la philosophie et qui suscite, depuis la publication en 1905 de « On Denoting » par Russell, les plus vifs débats en philosophie analytique. Cependant, le débat féroce sur la sémantique des noms propres et des descriptions définies qui surgirent suite à la publication du « On Referring » par Strawson en 1950 n’engagea pas d’étude systématique de la sémantique des fictions. En fait, (...) le développement systématique d’un lien qui articule approches logiques, philosophiques et littéraires de la fiction devait attendre les travaux de John Woods publiés en 1974 dans son livre The Logic of Fiction : A Philosophical Sounding of Deviant Logic. Un des enjeux les plus excitants du livre de Woods se situe au niveau de l’interaction entre les points de vue internalistes ou interne-à-l’histoire (principalement pragmatiques) et les points de vue externalistes ou externe-à-la-fiction (principalement sémantiques). Sur ce point, Woods fut le premier à formuler une sémantique pour l’opérateur de fiction à lire comme « selon l’histoire… » en relation à la notion logique de portée, ce qui permettait l’étude de l’internalisme et de l’externalisme. Suite au livre de Woods, loin de s’essouffler, les débats trouvaient une nouvelle impulsion. Le fait pertinent pour notre article est que la tradition phénoménologique également, l’étude de la fiction a joué un rôle central. En effet, l’une des problématiques les plus sujettes à controverses dans l’intentionnalité est celle de l’indépendance à l’existence, c’est-à-dire le fait que les actes intentionnels n’ont pas besoin d’être forcément dirigés vers un objet existant. Influencée par les travaux de Roman Ingarden (1893-1970), l’un des plus importants disciples de Husserl, Amie L. Thomasson développe le concept phénoménologique de dépendance ontologique en vue d’expliquer les processus de références inter- et transfictionnels – dans le contexte de l’interprétation littéraire par exemple. L’enjeu essentiel de cet article est de proposer une reconstruction multimodale bi-dimensionnelle de la théorie des personnages fictionnels de Ingarden-Thomasson. Cette théorie qui entend prendre au sérieux le fait que les fictions sont des créations montre la voie pour une articulation entre les approches internalistes et externalistes. Nous motivons certains changements quant à l’approche artéfactuelle - incluant une sémantique appropriée pour l’opérateur de fictionalité qui, nous l’espérons, éveillera l’intérêt des théoriciens de la littérature. L’article est à d’autres égards un panorama de la façon dont différents concepts d’intentionnalité pourraient fonder différentes sémantiques formelles pour la fictionalité. Nous proposerons enfin un cadre dialogique qui est une extension modale d’un certain système de preuve développé par Matthieu Fontaine et Juan Redmond. Le cadre dialogique développe la contrepartie inférentielle de la sémantique bi-dimensionnelle introduite par Shahid Rahman et Tero Tulenheimo dans un article récent. (shrink)

Policing ethics or related unethical behaviors, in particular, are shaped by both societal perceptions and organizational socialization of the police personnel on how authority should be exercised, as well as the latter's relationship with the socio-political and economic structures overtime. This paper proposes to explain the role of police as the main law enforcement agency in any democratic country. An Attempt has been made to bring different perspectives of ethics which comprises views of Aristotle, Machiavelli, Immanuel Kant, J S Mill and John Rawls. The paper focuses on police Ethics. Avec l’article « Aristotle’s natural deduction system », publié en 1974, J. Corcoran a contribué à diffuser une nouvelle perspective sur les écrits logiques d’Aristote et sur la théorie du syllogisme en particulier. Dans cet article, Corcoran affirme que, dans les premiers chapitres des Premiers Analytiques, Aristote ne propose pas un système axiomatique, qui supposerait une logique sous-jacente, ainsi que le pensait Łukasiewicz, mais plutôt un système de déduction naturelle, avec des dimensions métalogiques. Notre propos est ici basé sur une (...) courte monographie de Kurt Ebbinghaus, intitulée Ein formales Model der Syllogistik des Aristoteles (1964), où est fixé le canon de cette nouvelle perspective mentionnée plus haut et qui a été développé dans le cadre conceptuel de la « logique opérative » de Paul Lorenzen. Ebbinghaus développe une reconstruction formelle montrant que l’approche d’Aristote relève de la « théorie de la preuve », non seulement pour ce qui concerne le système d’inférence sous-jacent, mais aussi pour ce qui concerne les éléments métalogiques. C’est notamment à travers ce dernier aspect que se manifeste une différence majeure par rapport à la reconstruction de Corcoran. Alors que celui-ci pose que le système d’inférence d’Aristote est enraciné dans une sémantique de théorie des modèles (élaborée par Corcoran lui-même), Ebbinghaus comprend que la théorie du syllogisme a été développée à partir d’une approche de la signification par des règles (« rule based »), semblables aux règles d’un jeu. En fait, la reconstruction d’Ebbinghaus offre une lecture pragmatiste de la syllogistique d’Aristote, qui, tel est notre propos, paraît non seulement beaucoup plus proche du point de vue d’Aristote que ne l’est la sémantique de théorie des modèles proposée par Corcoran, mais qui, de plus, permet de saisir l’unité systématique de la théorie du syllogisme. RésuméAristote n'a pas développé une théorie de la quantification du prédicat, mais une étude récente de Hasnawi a montré qu'Ibn Sīnā a consacré à celle-ci une étude rigoureuse. Assumant la structure aristotélicienne sujet-prédicat, Ibn Sīnā qualifie les propositions qui comportent un prédicat quantifié, de propositions déviantes. Une conséquence de cette approche avicennienne est que la seconde quantification est absorbée par le prédicat. La distinction claire ainsi opérée entre un sujet quantifié, qui pose le domaine de la quantification, et une partie (...) prédicative, qui construit une proposition sur ce domaine, correspond structurellement à la distinction, faite dans la théorie constructive des types, entre le type des ensembles et le type des propositions.Aristote n'a pas non plus combiné son analyse logique de la quantification avec sa théorie ontologique des relations ou de l’égalité. Ibn Sīnā, en revanche, a utilisé les syllogismes qui nécessitent une logique de l’égalité et il a examiné des cas où la quantification se combine, via l’égalité, avec des termes singuliers. En outre, ces réflexions sont essentielles pour sa théorie des nombres qui est fondée sur l'interaction entre l’un et le multiple. Lorsqu'on combine la théorie métaphysique de l’égalité telle qu'on la trouve chez Ibn Sīnā avec son travail sur la quantification du prédicat, il en résulte tout naturellement une logique de l’égalité. En effet, l'interaction entre la quantification du prédicat et l’égalité peut être appliquée aux exemples de syllogismes mentionnés par Ibn Sīnā dans lesquels ces notions interviennent. En utilisant les instruments formels fournis par la théorie constructive des types de Martin-Löf, cet article établit des liens entre la métaphysique d'Ibn Sīnā et son travail logique, liens qui ont été discutés en relation avec d'autres sujets par Thom et Street. The main aim of the paper is to offer a solution compatible with Graham Priest’s Noneism and Amie Thomasson’s Artifactual theory which stresses the epistemic features of the notion of individuality in fiction in a framework where individuals are conceived of as functions (the framework is known as the world-lines-semantics of Hintikka). According to our view, it is the endorsement of a reader’s perspective that extends the range of the values of the functions (individuals) and that offers an alternative solution (...) to cases of identity inside and outside the scope of a fictionality (or representation) operator. More technically, this proposal can be seen as both extending the notion of individuality of the Artifactual theory and furnishing an epistemic twist to Priest’s principle of freedom. (shrink)

The present study on al-Dīn Suhrawardī's Ḥikmat al-Ishrāq, develops some preliminary explorations on his logic under the background of his remarkable epistemology of pis some witness of d resence. The paper paves the way for responding to the challenges of Tony Street on the compatibility of Suhrawardī's critique of Ibn Sīnā with the development of a temporal and modal syllogism that at first sight seems quite close to that of Ibn Sīnā. In fact, Suhrawardī's modalities are to be understood as (...) the different ways a predicate relates to its subject rather than as propositional operators. Accordingly, necessarily necessary modality relates actual instances (presences) of the Subject-Term with actual (presences) of the Predicate-Term; in contrast, necessarily contingent modality relates these terms conditionally, notably involving states of the Subject-Term within time intervals. Suhrawardī's main innovation, so we claim, is the explicit dialectical role presences or actual instances have in his modal-temporal logic, and particularly so in shaping his notion of contingency that admits both a generic and an individual or de re form of plenitude. The government of the State of Ohio determined to design several mandatory programs in regular classes to help NRC’s female in mates to prepare themselves upon their release back to the community; one of the programs is Islamic teaching. It is a chance to insert and implement the innovated peaceful Islamic propagation beside the conventional one, especially in western countries like the United States of America. The chance for an innovated dakwah is open upon observing that a lot of non- (...) Muslimah in mates were curious about Islam in an inter-religious meeting. The Arabic script classis not a part of mandatory NRC programs, it is voluntary for non- Muslimin mates designed and implemented by the author. They learn to write and pronounce the Arabic alphabet from “alif’ to ‘ya’ within six weeks. This free class is to support the government programs in order to reduce recidivism among in mates, and upon completing this class they are encouraged to attending the Islamic teaching class. This paper is qualitative research using a sociology approach. The data collection for this research is using participative observation, voluntary interview, and documentation; the collected data were analyzed in the descriptive-qualitative method. The effectiveness and efficacy of the research should be measured in a quantity of non- Muslimah in mates who gradually and peacefully convert to become Muslimah after attending the Arabic script class. The benchmark of effectiveness should be affirmed in mathematic formula i.e. the effectiveness is equal to the number of Muslimah converts divided by the total participant time 100; it is x 100 = 33.33%. Among 9 non- Muslimah participants of free Arabic script class,3 of them converted to be Muslimah. (shrink)

This monograph proposes a new way of studying the different forms of correlational inference, known in the Islamic jurisprudence as qiyās. According to the authors’ view, qiyās represents an innovative and sophisticated form of dialectical reasoning that not only provides new epistemological insights into legal argumentation in general but also furnishes a fine-grained pattern for parallel reasoning which can be deployed in a wide range of problem-solving contexts and does not seem to reduce to the standard forms of analogical reasoning (...) studied in contemporary philosophy of science and argumentation theory. After an overview of the emergence of qiyās and of the work of al-Shīrāzī penned by Soufi Youcef, the authors discuss al-Shīrāzī’s classification of correlational inferences of the occasioning factor. The second part of the volume deliberates on the system of correlational inferences by indication and resemblance. The third part develops the main theoretical background of the authors’ work, namely, the dialogical approach to Martin-Löf's Constructive Type Theory. The authors present this in a general form and independently of adaptations deployed in parts I and II. Part III also includes an appendix on the relevant notions of Constructive Type Theory, which has been extracted from an overview written by Ansten Klev. The book concludes with some brief remarks on contemporary approaches to analogy in Common and Civil Law and also to parallel reasoning in general. (shrink)

The overall objective of the study was to examine the pros and cons of the participatory approach adopted in natural resource management in the ecologically protected areas of the Sundarbans mangrove of Bangladesh. A comparative study was done between the people who are involved and non-involved in this approach. Empirical data was collected through personal interviews with a structured questionnaire. The Gini coefficient was measured first and then embedded with the Lorenz curve to draw a line between perfect equality and (...) inequality vis-a-vis. The study revealed that the co-management built awareness in favor of biodiversity conservation and the efficient use of natural resources. Contradictorily, a segment of different hierarchical committees was involved in destructive activities like poisoning the wetlands for fishing. Therefore, a mixed outcome was found. The findings will help the policymakers in identifying the pitfalls and bottlenecks rooted in co-management. Hence, the study recommends revising the approach to ensure the community’s active participation on an equal basis and take action against them who degrade those resources. Exploring profitable alternative income-generating activities is warranted to narrow down the dependency on the Sundarbans mangrove’s natural resources. In order to address the tragedy of the commons, the study advocates for the unity of all knowledge ranging from science to humanistic scholarship for sound policymaking. (shrink)

The study examines if women politicians of Pakistan in the media are portrayed as effective decision-makers who demonstrate their leadership abilities and dynamism in advocating women issues. It aims to study whether media was used as an organized effort to use political women to bring social and economic improvement in the status of women by examining the Pakistani media on the issues of women during Pakistan’s 2013 general elections. It explores the assumption put forward by the ‘critical mass theory’, that (...) if women form the critical mass in the political power structure, they have a major effect on becoming a voice in the media for women issues. It is a content analysis of articles, editorials and features of four major dailies and talk shows of three major television channels during the Pakistan’s election year 2013. Findings show that women issues were just not sidelined but also women politicians were marginalized in the media to talk on women issues. The discourses on women by ‘empowered’ women were almost non-existent in the media. (shrink)

One of the epistemological results emerging from this initial study is that the different forms of co-relational inference, known in the Islamic jurisprudence as qiyās, represent an innovative and sophisticated form of reasoning that not only provides new epistemological insights into legal reasoning in general but also furnishes a fine-grained pattern for parallel reasoning which can be deployed in a wide range of problem-solving contexts and does not seem to reduce to the standard forms of analogical argumentation studied in contemporary (...) philosophy of science. However, in the present paper we will only discuss the case of so-called co-relational inferences of the occasioning factor and only in the context of Islamic jurisprudence. (shrink)

The passionate and staunch defence of logic of the controversial thinker Ibn Ḥazm, Abū Muḥammad ʿAlī b. Aḥmad b. Saʿīd of Córdoba (384-456/994-1064), had lasting consequences in the Islamic world. Indeed, his book Facilitating the Understanding of the Rules of Logic and Introduction Thereto, with Common Expressions and Juristic Examples (Kitāb al-Taqrīb li-ḥadd al-manṭiq wa-l-mudkhal ilayhi bi-l-alfāẓ al-ʿāmmiyya wa-l-amthila al-fiqhiyya), composed in 1025-1029, was well known and discussed during and after his time; and it paved the way for the studies (...) of his compatriots Ibn Bājjah (d. 1138), Ibn Ṭufayl (1185), and Ibn Rushd (1198), who each gave demonstrative reasoning a privileged place within the methods of attaining knowledge. Unfortunately, as too often in the history of science, Ibn Ḥazm’s innovative perspectives and contributions in logic have been overlooked or considered with an attitude of contempt. On the one hand, his work has been seen, at best, as promulgating the benefits of studying Aristotle’s logic, so that his contribution is assessed as more didactical than conceptual. And on the other hand, those who do examine his innovations often consider them to be mistaken. As indicated by Chejne (1984, p. 2) contempt towards the logical work of Ibn Ḥazm was also present in its reception by the Eastern philosophers who accused him of deviating from Aristotelian logic and of dabbling in things beyond his capability. However, a reassessment of his work on logic has since begun, by delving into the ways the thinker of Córdoba studied the links between deontic and modal qualification of propositions. In this context Lameer’s (2013) paper on the logical sources of Ibn Ḥazm is worth mentioning; the author (p. 417, footnote 1) observes that, although, strictly speaking, it was al-Fārābī who first drew the parallelism between deontic and modal concepts, it was Ibn Ḥazm who developed it and worked it out in a more precise manner. A primary aim of this paper is to help fill some of these gaps by stressing the role of the work of Ibn Ḥazm in developing a notion of deontic necessity deeply rooted in legal normativity, and in explicitly discussing the transference between deontic and modal concepts. According to our view; the basic units of Islamic deontic logic are what we might call, indulging in terminological anachronism, heteronomous imperatives. As it turns out, the heteronomy of imperatives within Islamic legal systems contrasts with those of the purely moral realm, which seem to be closer to an autonomous conception of moral law. There it concurs again with Leibniz’s proposal to define obligatory as “what is necessary for a good person to do”. In the present paper, we will focus on the heteronomous imperatives of legal systems rather than on the imperatives of the purely moral realm. In this context, the work of Ibn Ḥazm extends the parallelism between the necessity of events and that of human actions stressed by his predecessors. According to our understanding, Ibn Ḥazm’s parallelism can be rendered explicit formally by means of a conditional (or hypothetical) structure shared by both deontic and modal propositions. Moreover, this structure makes apparent that this parallelism displays an underlying system of “degrees”. Indeed, while in the domain of events, given some conditions, it makes sense to distinguish between an event that is more likely to happen than another. Ibn Ḥazm speaks of near and distant possibility (such as the higher degree of likelihood of rain, given the condensation of clouds in December, and its lower degree, when the condensation occurs in summer); and, in the domain of actions, the Islamic notion of weighting actions determines degrees of virtue (or of legal and moral value). So whereas the degree of virtue of performing a forbidden act as determined by the distribution of sanction and reward is 0, we obtain the same value by pondering the likelihood of an impossible event to take place. Furthermore, as discussed in section II.3.2, the system of values at work in the parallelism can be seen as opening the way to a more direct correspondence. Thus, while in the realm of nature, likelihood of occurrence of an event is dependent upon the conditions specific to the occurrence of that event; while, in the realm of jurisprudence, likelihood of performing an action is dependent upon the distribution of reward and sanction specific to that action (being that, given the choice to perform or not perform a given action, those that will be rewarded are more likely to be performed than those that are not). According to this perspective, the point of the parallelism is that both deontic and modal qualifications measure the degree of an action or event to become actual; that is – indulging once more in anachronism (but this time from the Leibnizian background) – the degree measures how feasible (facile) an action or event may be. This suggests that Ibn Ḥazm’s perspectives already herald the links to probability and possibility explored by Leibniz six centuries later – see for example Leibniz’s (1671, A VI, I, p. 424-26) use of probability in the context of conditional right. Nevertheless, it also shows a crucial difference to the approach developed in the Elementa Jura Naturalis: whereas Leibniz’s studies seek to define what is to be just or virtuous, the logical system of deontic imperatives within Islamic jurisprudence presupposes that what is to be virtuous has already been settled. Determining what is to be virtuous is not achieved by logical reasoning within the system of legal jurisprudence, but by delving into the higher objectives of the Sharīʿa. While developing our point, we will delve into the logical structure of the heteronomous imperatives. This distinguishes our contribution from the existing literature, such as the papers of Chejne (1984), Lameer (2014), and Guerrero (1997, 2010, 2014), which do not provide a logical analysis of the deontic concepts put into work by Ibn Ḥazm. The true antecedent to the present paper is the work of Farid Zidani (2007, 2015), who, so far as we know, was the first to undertake such a task. Some of our own developments and general epistemological thoughts go beyond Ibn Ḥazm’s framework and motivations; mainly those contained in sections II.3.2 and IV. However, according to our view, these reflections suggest that Ibn Ḥazm’s approach has the substance for a broader and deeper exploration of the logic of norms. The paper is structured as follows:I.Ibn Ḥazm’s Logic of Heteronomous Imperatives. After presenting some extracts of the relevant text, we proceed by providing a formal reconstruction of the five forms of deontic modalities. II. A Landmark in the History of the Logical Analysis of Norms. Duties and Modalities. In this section, we study the transferences from deontic to modal necessity and possibility. We briefly compare the deontic system of Islamic Jurisprudence with that of Leibniz.III. Leibniz and Hypothetical Imperatives in Law.IV. Beyond Ibn Ḥazm: Conclusions and the Work Ahead. We will conclude the paper by discussing briefly some conceptual points that distinguish the logic of heteronomous imperatives from contemporary deontic logic. Our final words will discuss deontic-modal parallelism in the context of Ibn Ḥazm’s rejection of reasoning by conjecture and what we call “the internalization of nature.”. (shrink)
